HERVEY BAY LAWNMOWING SERVICE AGREEMENT

This Service Agreement ("Agreement") is entered into as of the date of acceptance by Client, between Hervey Bay Lawnmowing ("Company"), and the client identified on this Agreement ("Client"). The Company provides lawn mowing and related services to Clients in the Hervey Bay area. This Agreement outlines the terms and conditions under which such services will be provided.

  1. PARTIES: This Agreement is made between Hervey Bay Lawnmowing (ABN 31556849697), referred to as the "Company," and *********** , (NDIS # ************), referred to as the "Client."

  2. SCOPE OF WORK: The Company agrees to provide lawn mowing services at the property located at ******************** Hervey Bay, Queensland (the "Property") on a regular basis, subject to the availability of the Company's resources and weather conditions. The specific details of the services shall include:

    • Regular mowing of the lawn areas according to normal growth patterns, typically every 7-14 days during growing seasons and less frequently during winter months;

    • Edging of driveways, paths, and other hard surfaces using an edger or string trimmer where applicable;

    • Removal of clippings from the Property;

    • Blowing leaves and debris off paved surfaces.

  3. TERM AND TERMINATION: This Agreement will begin on [Start Date] and continue until terminated by either party with written notice. In the event that Client wishes to cancel the Agreement prior to its expiration, they must give at least two weeks' written notice to the Company. If the Company breaches any material provision of this Agreement, Client may terminate the Agreement immediately upon providing written notice to the Company.

  4. COMPANY OBLIGATIONS: The Company represents and warrants that it has all necessary licenses and insurance coverage to perform the services described herein. The Company shall ensure that its employees are properly trained and equipped to carry out the work safely and effectively.   7. CLIENT OBLIGATIONS: The Client acknowledges that their cooperation is essential for the successful completion of the services. They agree to provide clear access to the Property and inform the Company of any hazards, special instructions, or changes to the Property that might affect the safety or efficiency of the work.

  8. PAYMENT: The Client agrees to pay the Company a fee of ************ inc GST per hour, for the services rendered. Payments are due within seven (7) business days following the invoice date. Late payments may result in additional fees or suspension of services.

  9. GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the State of Queensland, without giving effect to its conflict of law provisions. Any disputes arising from this Agreement shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration.

  10. ENTIRE AGREEMENT: This Agreement constitutes the entire understanding and agreement between the parties regarding the subject matter hereof, superseding all prior oral or written communications relating thereto. This Agreement may only be amended in writing signed by both parties.

  11. ASSIGNABILITY: Neither party may assign its rights or obligations under this Agreement without the prior written consent of the other party.

  12. SEVERABILITY: If any provision of this Agreement is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
